The proposed bill establishes that it is a fourth degree felony for any person to knowingly solicit a non-U.S. citizen to register to vote or to vote in New Mexico. The bill defines "solicitation" broadly to include any act of requesting or encouraging such actions, regardless of format. Importantly, including a disclaimer that advises the non-citizen not to register or vote does not serve as a legal defense against this violation. Each instance of solicitation is treated as a separate offense, and violators may face fines of up to $5,000 in addition to criminal penalties.

Furthermore, the bill empowers the attorney general or district attorneys to initiate criminal proceedings for violations of this law, with the option to seek assistance from state election officials during investigations and prosecutions. The provisions of this act are set to take effect on July 1, 2025.
