This bill introduces a new section to the Criminal Sentencing Act that enhances the basic sentences for certain felonies committed in connection with criminal street gang activity. If it is proven beyond a reasonable doubt that a felony was committed for the benefit of, at the direction of, or in association with a criminal street gang, the basic sentence will be increased based on the degree of the felony. For example, a fourth-degree felony will incur an additional year, while a first-degree felony will incur an additional eight years. The bill specifies a list of felonies that are subject to these enhancements, including murder, aggravated assault, robbery, and trafficking in controlled substances, among others.

Additionally, the bill stipulates that these sentence enhancements will run consecutively with the basic sentence and cannot be suspended or deferred. If multiple enhancements are imposed, they will run concurrently. The bill also defines "criminal street gang" and "pattern of criminal street gang activity" to clarify the scope of the law. The provisions of this act are set to take effect on July 1, 2025.
