The Digital Age Verification Act establishes new requirements for manufacturers of devices and application stores to implement age verification measures. Under this act, covered manufacturers must take reasonable steps to determine or estimate the age of users upon initial activation of devices. They are also required to provide a digital signal to websites and applications indicating the user's age group and to obtain parental consent for users under sixteen years of age who wish to download applications. Additionally, manufacturers must ensure that these age verification features are included in devices sold before January 1, 2026, within ninety days of the act's effective date.
The act defines key terms such as "application store," "covered manufacturer," and "device," and designates the state department of justice as the overseeing authority. Violations of the Digital Age Verification Act are classified as unfair and deceptive trade practices, making them actionable under the Unfair Practices Act. The provisions of this act will take effect on January 1, 2026.
