The bill amends Section 14-14A-28 of the New Mexico Statutes to increase the maximum fees that notary officers can charge for their services. Specifically, the maximum fees for various notarial acts have been raised from five dollars ($5.00) to twelve dollars ($12.00) for acknowledgments, oaths or affirmations without a signature, and jurats. Additionally, the fee for copy certifications has been increased from fifty cents ($0.50) to one dollar twenty cents ($1.20) per page, with a minimum total charge of twelve dollars ($12.00). Furthermore, the maximum technology fee that a notarial officer may charge for electronic records has been raised from twenty-five dollars ($25.00) to sixty dollars ($60.00).
The bill also clarifies that employers cannot set fees for notarial services that exceed the specified maximums and that notarial officers may charge a travel fee if agreed upon in advance. The provisions of this act will take effect on July 1, 2025.
