The bill mandates that all state educational institutions in New Mexico provide free menstrual products, specifically sanitary pads and tampons, in designated bathrooms. These products must be available at no charge in every women's bathroom, each gender-neutral bathroom, and at least one men's bathroom within these institutions. This new requirement is established through the insertion of a new section in Chapter 21, Article 1 of the New Mexico Statutes Annotated (NMSA) 1978.
Additionally, the bill includes an appropriation of one million dollars from the general fund to the higher education department for the fiscal year 2026. This funding is intended for the purchase and installation of menstrual product dispensers, as well as the procurement and distribution of menstrual products across state educational institutions, with allocations based on the proportion of female students. Any remaining funds at the end of the fiscal year will revert to the general fund.
