The Supported Decision-Making Act establishes a framework for individuals, referred to as decision-makers, to enter into supported decision-making agreements with designated supporters. This act defines key terms such as "adult," "decision-maker," "decision-making support," and "supporter," and outlines the scope and requirements of these agreements. Decision-makers are presumed to have the capacity to manage their affairs unless a court determines otherwise, and the act emphasizes that a supporter must act in good faith, avoid self-dealing, and respect the decision-maker's preferences. The act also prohibits supporters from making decisions on behalf of the decision-maker and establishes disqualifications for individuals who may serve as supporters.

Additionally, the act creates a Supported Decision-Making Program within the Office of Guardianship in the Developmental Disabilities Council, which will provide resources and assistance related to supported decision-making agreements. The program will facilitate the formation and termination of these agreements, monitor compliance with statutory requirements, and offer support for reporting suspected abuse or exploitation. The bill includes an appropriation of $289,000 from the general fund to support the program's implementation and staffing in fiscal year 2026.
