The bill amends Section 30-22-25 of the New Mexico Statutes to increase the penalties for aggravated battery upon a peace officer. It defines aggravated battery as the unlawful touching or application of force to a peace officer with the intent to injure while the officer is performing their lawful duties. The bill specifies that if the battery results in an injury that is not likely to cause death or great bodily harm but does cause painful temporary disfigurement or temporary loss or impairment of bodily functions, it is classified as a fourth degree felony.
Additionally, the bill escalates the penalty for aggravated battery that inflicts great bodily harm or is committed with a deadly weapon to a second degree felony, replacing the previous classification of a third degree felony. The effective date for these changes is set for July 1, 2025.
