This bill enacts new sections within the Public Assistance Act, the Health Care Purchasing Act, and the New Mexico Insurance Code to mandate coverage for fertility preservation services in specific medical situations. It defines "fertility preservation" as medical interventions for the procurement, cryopreservation, or storage of reproductive materials, and "iatrogenic infertility" as infertility caused by medical treatments such as surgery or chemotherapy. The bill requires that group health coverage and individual health insurance policies include coverage for medically necessary fertility preservation services when treatment may lead to iatrogenic infertility, as determined by the healthcare provider.
Additionally, the bill stipulates that health plans cannot impose separate deductibles or cost-sharing requirements for fertility-related services, except for amounts comparable to other medical services. Coverage must be provided without regard to the insured's expected length of life, disability, medical dependency, quality of life, or personal characteristics such as age, sex, or sexual orientation. The provisions of this act are set to take effect on January 1, 2026.
