This bill enacts new sections within the Health Care Purchasing Act and the New Mexico Insurance Code to mandate coverage for fertility preservation services under specific circumstances. The legislation defines "fertility preservation" as medical interventions such as the procurement, cryopreservation, or storage of oocytes, embryos, or gonadal tissue. It requires that group health coverage, individual or group health insurance policies, health care plans, and health maintenance organization contracts provide coverage for these services for enrollees or insured individuals whose disease or medically necessary treatment may lead to infertility, as determined by their healthcare provider.

The bill ensures that coverage for fertility preservation services is provided without discrimination based on various factors, including the individual's expected length of life, present or predicted disability, degree of medical dependency, perceived quality of life, or personal characteristics such as age, sex, sexual orientation, marital status, gender, or gender identity. The provisions of this act are set to take effect on January 1, 2026.
