The Electric Vehicle Charging Station Zoning Act establishes a framework for the permitting and installation of electric vehicle charging stations within county and municipal zoning districts in New Mexico. The act designates the installation of these charging stations as a permitted use, eliminating the need for a use variance. It mandates that zoning authorities create an expedited administrative process for permit applications, which will be subject only to compliance with existing construction codes, without consideration of non-code compliance issues such as aesthetics or parking impacts. Applications must be approved or denied within thirty business days of submission, and if deemed incomplete, applicants must be notified within fifteen days.

Additionally, the act outlines specific criteria for parking space designation, stating that a parking space used for electric vehicle charging will count as at least one standard parking space, and those designed for disability access will count as two. Zoning authorities are required to provide a checklist for permit applications and must inform applicants of any deficiencies within a specified timeframe. The provisions of this act will take effect on July 1, 2025.
