The act mandates that public libraries must adopt a written policy that aligns with the American Library Association's Library Bill of Rights, ensuring that materials are not removed or restricted based on partisan or doctrinal disapproval, or the author's race, nationality, gender identity, sexual orientation, or political or religious views. Additionally, libraries must either adopt a policy prohibiting the banning of materials or comply with the established collection development policy.
Furthermore, the act stipulates that public libraries will not be eligible for state funding unless they adhere to these policies. It also protects libraries from funding reductions by political subdivisions due to their compliance with the act. Importantly, while the act prohibits the banning of materials, it does not prevent individuals from challenging library materials through established procedures. The provisions of this act are set to take effect on July 1, 2025.
