AN ACT
MAKING AN APPROPRIATION FROM THE APPROPRIATION CONTINGENCY FUND TO THE DEPARTMENT OF TRANSPORTATION FOR INFRASTRUCTURE PROJECTS ON CERTAIN PORTIONS OF UNITED STATES HIGHWAY 380 AND NEW MEXICO HIGHWAYS 31 AND 128.
 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
     SECTION 1. APPROPRIATION.--Six hundred fifty million dollars ($650,000,000) is appropriated from the appropriation
contingency fund to the department of transportation for expenditure in fiscal years 2024 through 2026 for acquisition of rights of way, planning, design and construction and to match federal and other state funds for infrastructure projects on United States highway 380 from milepost 158 in Chaves county to the Texas state line; on New Mexico highway 31 in Eddy county from its intersection with United States highway 285 to its intersection with United States highway 62; and on New Mexico highway 128 in Eddy county and Lea county from its intersection with New Mexico highway 31 east to the Texas state line. Any unexpended or unencumbered balance remaining at the end of fiscal year 2026 shall revert to the appropriation contingency fund.
