This bill amends current law to allow specially exempt facilities, such as retirement communities and assisted living facilities, to offer swimming lessons, classes, or instruction through third-party entities without losing their exemption from mandatory first aid and lifeguard personnel requirements. Under the new provisions, these facilities can conduct swimming instruction as long as it is not open to the general public, limited to pre-registered participants, and scheduled during designated times separate from general facility use. Additionally, the instruction must be conducted by a certified lifeguard employed by the third-party entity who is physically present at the facility.

The bill specifies that a specially exempt facility will not be deemed ineligible for exemption from lifeguard and first aid requirements solely based on the presence of recreational features like diving boards or water slides. This legislative change aims to provide more flexibility for specially exempt facilities to offer swimming instruction while maintaining safety standards and ensuring that the facilities remain primarily available for their residents and authorized users.
