This bill mandates that all sales of memorials must be documented through a written contract that includes specific details such as the names and addresses of both the seller and purchaser, the name of the individual to be memorialized, a description of the memorial, the expected delivery or installation date, the location for delivery or installation, the total price including itemized charges, and the option for the purchaser to deposit payments into an escrow account. The contract must be signed by all parties and clearly outline all terms and conditions in understandable language.

Additionally, the bill stipulates that sellers must offer purchasers the option to deposit initial and scheduled payments into an escrow account at a federally insured banking institution. Upon the delivery or installation of the memorial, funds held in escrow will be disbursed to the seller according to the contract terms. Violations of this bill would be considered unlawful practices under the consumer fraud act, subjecting offenders to penalties, including monetary fines and potential legal actions by the Attorney General.
