The Sales Tax Holiday Weekend Act establishes an annual sales tax holiday occurring every third weekend in August, during which certain retail sales will be exempt from the state's sales and use tax. This exemption applies to tangible personal property purchased by individuals for personal, nonbusiness use, with a sales price of $3,000 or less per item. However, the exemption does not extend to prepared foods, alcoholic beverages, tobacco products, vapor products, cannabis items, and intoxicating hemp beverages.
To facilitate the implementation of this act, the Director of the Division of Taxation in the Department of the Treasury is granted the authority to adopt necessary regulations immediately upon filing with the Office of Administrative Law. These regulations will be effective for a period not exceeding 180 days and may be amended as needed. The act is set to take effect immediately and will apply to retail sales made during exemption periods that occur at least 30 days following its enactment.
