This bill mandates that developers of high energy use facilities, defined as those with a peak electrical load of at least 100 megawatts, must submit a site assessment as part of their application for preliminary site plan approval. The assessment must evaluate the sound impact on nearby residential units and schools within 500 feet of the facility, as well as provide information from the electric public utility regarding any necessary substations and transmission voltage. Additionally, the approving authority may require further examination of the facility's effects on ground and surface water resources, agricultural resources, parks and open spaces, historic sites, and forested land.

The site assessments will be utilized by the approving authority to ensure alignment with the municipality's master plan and adherence to local noise and zoning ordinances. Importantly, the bill clarifies that it does not limit or supersede existing local zoning authority, thereby maintaining local governance over land use decisions. The act is set to take effect immediately upon passage.
