This bill addresses noise abatement for data centers in New Jersey by establishing specific requirements for site plan approval and operational compliance. It prohibits approving authorities from granting site plan approvals for data centers if the property owner or operator fails to meet certain conditions. Before site plan approval, the property owner or operator must conduct a sound study by a certified acoustic engineer to document existing baseline sound levels in the area. The bill mandates that data centers be designed with adequate noise abatement measures to comply with municipal noise control ordinances, including the installation of acoustic barriers around cooling units and generators. Developers must submit design specifications for these measures to the municipality before obtaining a building permit.

Once operational, data center operators are required to conduct annual noise studies for three years, performed by a certified acoustical engineer, to assess compliance with municipal noise ordinances. The results of these studies must be submitted to the municipality within 60 days of completion. Additionally, the bill allows local governing bodies to impose fines on data center operators for noncompliance and grants the Commissioner of Community Affairs the authority to adopt necessary regulations to implement the bill's provisions.
