This bill proposes the removal of the existing 16-hour limit on private duty nursing services for Medicaid enrollees aged 21 and older. Currently, under N.J.A.C.10:60-5.9, these services are restricted to a maximum of 16 hours within a 24-hour period. The new legislation allows eligible individuals to receive up to 24 hours of private duty nursing services in a day, contingent upon the severity of their illness as determined by the Commissioner of Human Services.

Additionally, the bill mandates that the Commissioner of Human Services seek any necessary state plan amendments or waivers to implement these changes and to ensure federal financial participation in state Medicaid expenditures. The act is set to take effect on the first day of the seventh month following its enactment, although the Commissioner may take preliminary administrative actions to facilitate its implementation.
