This bill mandates that public school districts in New Jersey provide a daily recess period of at least 20 minutes for students in grades kindergarten through eight, expanding the current requirement which only covers grades kindergarten through five. The recess must be held outdoors if feasible, and students cannot be denied recess except for specific violations of the district's code of conduct. If a student is denied recess, they must be offered restorative justice activities instead, and they cannot be denied recess more than twice a week. Additionally, the bill clarifies that recess cannot be used to fulfill course requirements and allows for exceptions based on medical advice or a student's 504 plan.

Furthermore, the bill introduces a new requirement for school districts to provide a daily lunch period of at least 30 seated minutes for students in grades kindergarten through eight on days when school is in full session. This provision aims to ensure that students have adequate time for both lunch and recess, promoting their overall well-being and development. The act is set to take effect immediately and will apply to the first full school year following its enactment.
