This bill allows for-profit movie theaters to obtain a plenary retail consumption license, enabling them to sell alcoholic beverages under specific conditions. The governing body of a municipality, with the approval of the Director of the Division of Alcoholic Beverage Control, can issue this license to for-profit entities that operate motion picture exhibition facilities. The license permits the sale of alcoholic beverages two hours before the showing of first-run motion pictures and during scheduled exhibitions. The application for the license must be submitted annually to the municipal governing body, with an initial issuance fee set at $210,000, which can be reduced to $150,000 if a certain percentage of the beverages sold are produced by specific licensed breweries or wineries.
Additionally, the bill stipulates that the license is non-transferable and must remain associated with the qualifying motion picture exhibition facility. It will expire if the facility permanently ceases operations. Notably, licenses issued under this bill will not count towards the existing limits on the number of licenses a municipality can issue based on its population. This legislation aims to provide movie theaters with the opportunity to enhance their offerings and revenue streams while adhering to regulatory guidelines.
