This bill allows construction companies, contractors, and subcontractors to initiate legal action against one another for various alleged offenses, including wage or benefit theft, misclassification of employees, tax or insurance fraud, bid manipulation, falsification of documentation, and violations of the New Jersey Antitrust Act or the consumer fraud act. To proceed with such an action, the plaintiff must notify the potential defendant at least 30 days before filing the lawsuit and must also inform the Department of Labor and Workforce Development.
Additionally, the bill stipulates that if the plaintiff prevails in the lawsuit, the court is required to award reasonable attorneys' fees and costs, which may include expert witness fees. The definitions of "construction company," "contractor," and "subcontractor" are aligned with existing legal definitions in New Jersey law. This legislation is set to take effect immediately upon passage.
