The GAI Accountability Act establishes civil penalties for owners, operators, and developers of generative artificial intelligence (GAI) platforms that engage in harmful activities, particularly those that exploit children. Under this legislation, any GAI platform that operates within New Jersey or is accessible to its residents can be held liable for failing to prevent conduct that would constitute serious crimes, such as murder, assault, theft, and the creation of child sexual abuse material. Additionally, these platforms can be penalized for providing information that aids users in committing such crimes, unless that information is available from other public sources.

The bill stipulates a civil penalty of $20,000 for each violation and allows for an affirmative defense if the platform's owner, operator, or developer can demonstrate that they made reasonable efforts to prevent such violations. Enforcement of this act will be the responsibility of the Attorney General, and it is set to take effect four months after its enactment.
