This bill amends current law to allow retired municipal code officials to return to part-time employment without having to reenroll in the Public Employees Retirement System (PERS) after a 90-day waiting period. Specifically, it introduces a new provision that permits these former members, who have received a retirement allowance for reasons other than disability, to be re-employed as municipal code officials under certain conditions. These conditions include that the return to work must start at least 90 days after retirement, the individual must have reached the applicable service retirement age at the time of retirement, and the re-employment must be part-time, limited to no more than 20 hours per week.

Additionally, the bill stipulates that the retirement must be a bona fide retirement, and it explicitly prohibits any prearranged employment before retirement. This new provision is designed to ensure that the integrity of the retirement system is maintained while allowing retired municipal code officials to re-enter the workforce in a limited capacity. The bill will take effect immediately upon passage, provided that the qualified status of the retirement system under federal law can be maintained.
