This bill mandates the prohibition of lead ammunition in hunting within the State of New Jersey, requiring the exclusive use of nonlead ammunition. Nonlead ammunition is defined as any ammunition that contains one percent or less of lead or is classified as nonlead by the federal government. The Fish and Game Council is tasked with phasing in restrictions on lead ammunition over a three-year period, ultimately leading to a complete ban. Additionally, the council must create and maintain a list of certified nonlead ammunition, which will include federally approved options. Importantly, these regulations will not apply to government officials or their agents when performing statutory duties unrelated to wildlife management.
Violations of the nonlead ammunition regulations will incur penalties ranging from $100 to $1,500 for first offenses, and up to $4,000 for subsequent offenses. The bill also includes provisions for the council to adopt necessary rules and regulations to implement these changes in accordance with the Administrative Procedure Act. The act is set to take effect immediately upon passage.
