The Academic Freedom in Higher Education Protection Act aims to safeguard the independence and academic freedom of institutions of higher education in New Jersey. The bill asserts that these institutions should have the authority to make academic and operational decisions without interference from the Executive Branch of State Government or any related entities, while still allowing the Secretary of Higher Education to retain specific responsibilities as outlined in existing law. Additionally, faculty members are granted the academic freedom to engage in teaching, research, and other scholarly activities without external interference, provided they adhere to the institutions' policies and standards.
The bill also establishes a mechanism for addressing violations of its provisions through the Superior Court of New Jersey. It allows for the filing of complaints and stipulates that a preliminary injunction may be issued if the complainant can demonstrate immediate harm and a likelihood of success on the merits of the case. Furthermore, the court has the discretion to award reasonable attorneys' fees and costs to the prevailing party during litigation, including at the time of issuing a preliminary injunction.
