This bill aims to establish protections for immigrant students and their families within New Jersey's public schools. It mandates the Commissioner of Education, in collaboration with the Attorney General, to develop a model policy that outlines the responsibilities of public schools and their employees when interacting with federal immigration authorities or during immigration enforcement actions. The model policy will prohibit schools from maintaining or disclosing any student records related to immigration status, using school resources to investigate immigration status, allowing federal authorities into non-public areas of school property, participating in civil immigration enforcement, and complying with civil immigration warrants.

Additionally, the bill requires the Commissioner to publish the model policy on the Department of Education's website and distribute it to all public school governing bodies within 90 days of the bill's effective date. Schools must adopt this policy within 180 days, although those with existing policies that offer similar protections may request an exemption. Importantly, the bill clarifies that it does not prevent schools from responding to valid judicial warrants and does not restrict actions that would conflict with federal law.
