This bill amends existing law to require health club services contracts to include specific provisions addressing procedures during an outbreak of infectious disease. It mandates that if a health club facility is closed due to a state of emergency or public health emergency declared by the Governor, the facility must notify buyers about the closure and reopening, as well as their payment obligations. Additionally, buyers will have the option to place their membership on hold during the emergency, waiving any recurring payment obligations, or to cancel their membership due to health concerns without incurring any cancellation fees or penalties.
Furthermore, the bill introduces definitions for terms such as "automatic renewal" and "clear and conspicuous," and clarifies that an "outbreak" refers to any unusual occurrence of disease or any disease above background or endemic levels. The changes aim to enhance consumer protection and provide clarity for both health clubs and their members during public health crises.
