This bill prohibits sellers from imposing credit card surcharges on customers for transactions occurring in New Jersey. Previously, sellers could charge a surcharge as long as it did not exceed the actual cost of processing the credit card payment. The bill also introduces new notice requirements for sellers who set a minimum transaction amount for credit card acceptance and for those who offer discounts for payments made by cash, check, or debit card instead of credit card.
Additionally, the bill specifies that sellers must provide clear and conspicuous notice regarding minimum transaction amounts and cash discounts at the point of entry and point of sale, or through electronic means for online transactions. Notably, the bill does not apply to motor fuel retail dealers, who may still have different pricing structures for cash and credit card payments. The act is set to take effect immediately upon passage.
