This bill mandates the Director of the Division of Consumer Affairs to establish a model policy for the use of generative artificial intelligence (AI) by licensed professionals within three months of the bill's enactment. The model policy will be created despite the usual requirements of the "Administrative Procedure Act." Following the establishment of this model policy, each professional or occupational board is required to adopt it, with any necessary adaptations specific to their profession, within six months or at their next scheduled meeting.
Generative artificial intelligence is defined in the bill as a technology system that is trained on data, simulates human communication through text, audio, or visual means, and generates outputs with limited or no human oversight. The rules and regulations established under this bill will remain in effect for up to one year before they must be formally adopted, amended, or readopted in accordance with the "Administrative Procedure Act." The bill is set to take effect immediately upon enactment.
