This bill regulates the use of artificial intelligence in the advertising of dwelling units and dwelling sites for lease or sale in New Jersey. It prohibits sellers and their agents from using photos that have been created or edited with generative artificial intelligence or other photo editing software that fundamentally alters the image. The bill mandates that any photos used in advertisements must accurately reflect the current state of the property and be no older than five years. However, it allows for the use of generative artificial intelligence or photo editing software to add non-fixed items, such as furniture, as long as the original state of the dwelling is maintained. Sellers must disclose the use of such technology in their advertisements and provide unaltered images upon request.
Violations of this bill will result in civil penalties, starting at $500 for the first offense and escalating to $1,000 for subsequent offenses. The New Jersey Real Estate Commission is authorized to create necessary regulations to implement the bill's provisions. The act is set to take effect on the first day of the second month following its enactment, with provisions for the Commission to take anticipatory actions as needed.
