This bill establishes that it is an unlawful practice for any person, business, or entity to solicit individuals for business based on the publication of death notices or obituaries, including those from public records, concerning a family member or tenant residing on a property within the first 90 days of such publication. The bill defines "family member" broadly to include various relations by blood, marriage, or adoption.
Violations of this law will be treated as violations of the New Jersey Consumer Fraud Act, which carries penalties of up to $10,000 for a first offense and up to $20,000 for subsequent offenses. Additional consequences may include cease and desist orders from the Attorney General, punitive damages, and the possibility of treble damages and costs awarded to the injured party. The act is set to take effect immediately upon passage.
