This bill amends the New Jersey Gestational Carrier Agreement Act to establish specific residency and domicile requirements for gestational carriers. It stipulates that, in order to be eligible to enter into a gestational carrier agreement, a gestational carrier must be a lawful resident of New Jersey or have been lawfully domiciled in the state for at least 12 months prior to the execution of the agreement. This new requirement is added to the existing criteria, which include being at least 21 years old, having given birth to at least one child, and completing both medical and psychological evaluations.

Additionally, the bill maintains the requirement that the gestational carrier must retain an independent attorney to discuss the terms and legal implications of the agreement, with the intended parent potentially covering the attorney's fees. The intended parent must also complete a psychological evaluation and be represented by an attorney. The bill is set to take effect immediately upon passage.
