The new legislation allows eligible individuals to receive up to 24 hours of private duty nursing services in a single day, contingent upon the severity of their illness as determined by the Commission of Human Services.
Additionally, the bill mandates that the Commissioner of Human Services seek any necessary state plan amendments or waivers to implement these changes and to ensure federal financial participation in state Medicaid expenditures. The Commissioner is also tasked with adopting rules and regulations to facilitate the bill's objectives. The act is set to take effect on the first day of the seventh month following its enactment, although anticipatory administrative actions may be taken prior to this date.
