This bill legalizes the growing and possession of marijuana plants for personal use by individuals aged 21 and older in New Jersey. Specifically, it allows for the cultivation of up to six marijuana plants for personal recreational use, with a maximum of 12 plants permitted per household. Additionally, qualifying patients and their designated caregivers can grow or possess up to 10 marijuana plants for personal medical use, also with a maximum of 12 plants per household. The bill stipulates that such possession and cultivation will not be considered a crime, offense, act of delinquency, or civil violation of law.
To implement these changes, the bill amends N.J.S.2C:35-4 by inserting new legal language that clarifies the conditions under which growing or possessing marijuana is permissible. It also removes previous legal language that classified possession of marijuana in larger amounts as a crime. Furthermore, the Cannabis Regulatory Commission is tasked with establishing rules and regulations to facilitate the enforcement of these provisions within 90 days of the bill's effective date. The act is set to take effect immediately upon passage.
