This bill amends existing food safety regulations in New Jersey by adding specific substances to the list of those that can render food for human consumption adulterated. The newly included substances are brominated vegetable oil, potassium bromate, propylparaben, and red dye 3. It establishes that it is unlawful for any entity to distribute, sell, manufacture, or possess with the intent to sell or distribute any food deemed adulterated, with enforcement to be carried out by the Department of Health. Violations of this law can result in penalties ranging from $50 to $1,000.
Additionally, the bill imposes a ban on six artificial food dyes—red 40, yellow 5, yellow 6, blue 1, blue 2, and green 3—from being served, sold, or given away on school property during the school day, including in the After School Snack Program. This prohibition on food dyes is set to take effect on August 1, 2028, while the provisions regarding commercial food will take effect one year after the bill's enactment.
