This bill establishes an alternative compliance method for the development of electric vehicle supply equipment (EVSE) and Make-Ready parking spaces, allowing developers to meet requirements based on total charging capacity rather than solely the number of equipped parking spaces. It aims to provide flexibility in compliance with existing laws while ensuring that the installation of EVSE aligns with uniform, statewide standards. The bill mandates that within 12 months of its effective date, the Site Improvement Advisory Board, in consultation with relevant departments, will adopt rules to implement this alternative compliance method, which will include standards for minimum charging capacity, safety, accessibility, and phased installation.

Additionally, the bill clarifies that municipalities and local land use boards cannot impose additional or inconsistent requirements regarding electric vehicle charging capacity or compliance methodologies beyond those established in the bill. It emphasizes that the alternative compliance method is optional and does not waive existing requirements under P.L.2021, c.171. The bill also stipulates that EVSE installed under this method may qualify for parking space credits, subject to existing limitations, and ensures that the implementation aligns with safety and accessibility standards. The bill will take effect immediately, but the alternative compliance method will only be operational after the necessary regulations are adopted.
