This bill mandates the installation of Type IV personal flotation devices, approved by the United States Coast Guard, at all lakes, ponds, and rivers within State parks or forests where swimming, boating, or ice-skating is allowed. The Department of Environmental Protection is responsible for ensuring these devices are permanently installed near the water, accompanied by signage indicating their presence. Additionally, the bill specifies that neither the department nor any State agency will incur liability related to this requirement.
Counties and municipalities are also required to install these flotation devices at similar locations within their parks, with the same liability protections in place. To facilitate the implementation of this bill, counties and municipalities are permitted to utilize funds from their respective Open Space, Recreation, Floodplain Protection, and Farmland and Historic Preservation Trust Funds. The bill is set to take effect immediately upon passage.
