This bill aims to regulate the use of artificial intelligence (AI) in communications related to election campaigns in New Jersey. It establishes specific restrictions on communications financed by various political committees and individuals, stating that any communication created or altered using AI cannot be published, circulated, or broadcast within 90 days before an election. Additionally, such communications must be clearly labeled with a statement indicating that AI was used in their creation. The bill also prohibits the use of deceptive audio or visual media generated or altered by AI that misrepresents an opposing candidate in a false or defamatory manner.
Violations of these provisions will result in the offender being charged with a crime of the fourth degree, which carries penalties of up to 18 months of imprisonment, a fine of up to $10,000, or both. The Election Law Enforcement Commission is tasked with adopting necessary rules and regulations to implement the bill's provisions. The act is set to take effect 60 days after its enactment.
