The bill classifies these generators as accessory structures, permitting their installation in all residential zoning districts without requiring a variance.
The legislation stipulates that the siting of these generators must comply with local setback requirements, or, if not feasible, a minimum five-foot side and rear yard setback can be applied with the approval of the municipal zoning officer, who cannot unreasonably withhold such approval. Additionally, the bill prohibits the placement of generators in front yards without local authority approval and mandates that any front yard installations minimize visual impact through landscaping and architectural materials. The use of these generators must also adhere to noise regulations, except during declared states of emergency.
