This bill amends current law to allow individuals whose spouse has passed away to revert their driver's license name to their birth name. The New Jersey Motor Vehicle Commission (MVC) will accept the most recent marriage certificate and the death certificate of the spouse as proof for this name change. Additionally, the bill stipulates that the licensee must attest that they have not been convicted of a crime, do not have any pending criminal charges, and are not seeking the name change to evade legal issues or commit fraud.
The bill also includes several amendments to the existing law regarding the recording of names on driver's licenses. It specifies that the legal name on the license must be in the licensee's own handwriting and defines "legal name" as the name on a birth certificate unless changed by marriage, divorce, or court order. Furthermore, it establishes that failure to notify the MVC of a name change within two weeks may result in a fine, but such fines will not incur additional surcharges under the Motor Vehicle Violations Surcharge System.
