The New Jersey Kratom Consumer Protection Act aims to regulate the sale and distribution of kratom products, defined as those containing the alkaloid mitragynine from the Mitragyna speciosa plant. The bill mandates that kratom retailers must disclose on product labels that the item is a kratom product and provide factual information regarding its contents. It prohibits the sale of kratom products that are adulterated or contaminated with dangerous non-kratom substances, exceed specified levels of certain alkaloids, or lack proper labeling. Additionally, the bill establishes age restrictions, prohibiting sales to individuals under 21 years of age, and requires retailers to verify age through valid identification.

Penalties for violations of the act include civil fines of up to $500 for first offenses and $1,000 for subsequent offenses, with a three-year prohibition on selling kratom products for third violations. Retailers may also face disorderly persons offenses for selling to underage individuals or for other infractions. The Department of Health is tasked with enforcing the act, including setting standards for product safety and labeling, and may impose fees for product registration. The act also requires the Department to conduct a study on kratom's health effects and report findings to the Governor within a year of its enactment.
