This bill amends New Jersey's consumer fraud act to prohibit the sale of crib bumpers by classifying them as unsafe children's products. The legislation defines a crib bumper as any material intended to cover the sides of a crib to prevent injury from impacts or to prevent entrapment of a child's body in openings. It specifically includes padded crib bumpers, vinyl bumper guards, and vertical crib slat covers, while excluding non-padded mesh crib liners. The bill also updates the criteria for determining unsafe children's products, adding crib bumpers to the existing definitions that include recalled products and those deemed hazardous by federal agencies.

Under the amended law, it becomes an unlawful practice for commercial users to remanufacture, sell, or otherwise distribute any children's product classified as unsafe, including crib bumpers. Violations of this law can result in significant monetary penalties, cease and desist orders, and potential punitive damages. Additionally, licensed child care centers will be prohibited from using crib bumpers, ensuring that any existing products are removed from their premises following the bill's enactment. The bill is set to take effect three months after its passage.
