This bill proposes the establishment of a restricted use drivers license as an alternative to license suspension for individuals whose drivers licenses have been suspended or revoked. Under the new provisions, individuals may apply to the municipal court for this restricted license, which would allow them to operate a vehicle solely for employment-related or education-related purposes. The court will assess the financial hardship the individual may face without a license and the likelihood of reoffending before granting the restricted use license. Notably, individuals whose licenses were suspended due to a conviction for driving under the influence (R.S.39:4-50) are excluded from eligibility.
If approved, the court will issue an order to the Chief Administrator of the New Jersey Motor Vehicle Commission, who will then issue the restricted use drivers license and a corresponding placard that must be displayed in the vehicle. The license will be distinguishable by its color and will permit driving only during specific hours and between designated locations. A fee of up to $100 will be charged for the license and placard, which will expire once the individual's full driving privileges are restored. This initiative is aligned with recommendations from the Supreme Court Committee on Municipal Court Operations, Fines, and Fees.
