This bill mandates that certain public restroom facilities be equipped with signs indicating that they are reserved for the exclusive use of persons with disabilities. Specifically, it applies to places of employment and public accommodations that have either a multiple-user public restroom with an accessible toilet compartment and at least one other toilet compartment or a single-user public restroom that is accessible and has at least two other single-user public restrooms available. The bill aims to prevent situations where individuals without disabilities occupy accessible restrooms, thereby ensuring that those who need them do not have to wait unnecessarily.

To enforce compliance, the bill stipulates that construction permit applications for new buildings or alterations to existing buildings containing applicable restroom facilities cannot be approved unless they include the required signage. Existing buildings will be subject to inspections, and if violations are found, owners will be given a 30-day period to correct them. Failure to comply may result in civil penalties of $150 for initial violations and $300 for subsequent violations at the same location. The bill also requires the Commissioner of Community Affairs, in consultation with the Commissioner of Human Services, to establish rules and regulations to implement these provisions effectively.
