This bill amends the Domestic Workers Bill of Rights (DWBR) in New Jersey to clarify the exemptions for certain workers and organizations from being classified as domestic workers. Specifically, it introduces new exceptions that include individuals who are duly licensed or certified under state law, such as certified homemaker-home health aides, as well as home care services agencies and licensed hospice care programs that comply with background check and credentialing requirements. These additions aim to ensure that professionals operating under regulatory frameworks are not subject to the same provisions as domestic workers.

Furthermore, the bill specifies that the term "hiring entity" does not encompass home care service agencies or licensed hospice care programs when it comes to services provided by licensed or certified workers acting within their professional scope. This change is intended to delineate the responsibilities and protections applicable to domestic workers versus those in regulated care professions, thereby refining the application of the DWBR. The bill is set to take effect immediately upon passage.
