This bill amends existing legislation regarding the installation and maintenance of solar panels in common interest communities in New Jersey. It specifies that homeowners associations cannot adopt or enforce any restrictions that prohibit the installation of solar collectors on the roofs of single-family homes and townhouse units. The bill removes previous language that required the roofs to not be designated as common elements or property in the governing documents of the association, as well as the stipulation that the repair of townhouse roofs must be the owner's responsibility.

Additionally, the bill allows associations to establish rules governing the installation and maintenance of solar collectors, including qualifications for installers, placement, concealment, color harmonization, and size limitations. However, it prohibits associations from enforcing rules that would significantly increase installation costs or inhibit the solar collectors' efficiency. The Commissioner of Community Affairs is tasked with enforcing these provisions, and the bill takes effect immediately upon passage.
