This bill amends existing law to extend the initial and renewal terms of property agreements between local governments and nonprofit organizations for recreation and conservation purposes. Specifically, it establishes that any lease or agreement entered into by a local government unit with a charitable conservancy or tax-exempt nonprofit organization will have an initial term of no more than seven years, which is an increase from the current maximum of five years. Additionally, if the local government unit seeks to renew the lease with approval from the Department of Environmental Protection, the renewal term will also be capped at seven years.
The bill further allows for longer lease terms under certain conditions. It stipulates that an initial lease or renewal term may be extended to up to 25 years if good cause is demonstrated, and terms may exceed 25 years with the approval of the Commissioner of Environmental Protection and the State House Commission. This codification of existing regulations aims to provide more flexibility for local governments and nonprofit organizations in managing property for public recreation and conservation efforts.
