This bill allows the New Jersey Legislature to terminate state of emergency and public health emergency declarations issued by the Governor, provided that a concurrent resolution receives a two-thirds affirmative vote from both Houses. It establishes that such declarations will automatically terminate 60 days after issuance unless the Legislature approves an extension. The bill also stipulates that the Governor can only renew a public health emergency declaration for an additional 30 days, after which it too will terminate unless extended by the Legislature. Extensions can be authorized for periods of 30 to 90 days, contingent upon receiving the necessary majority vote.

Additionally, the bill mandates that the Governor must notify the Legislature in writing at least seven business days prior to seeking an extension, detailing the reasons for the extension and the associated public health or safety threats. If the Governor fails to provide this notice, the declaration will terminate unless the Legislature approves an extension. The bill also clarifies that it does not apply to certain declarations, such as those that rescind existing orders or apply solely to executive branch operations. Furthermore, any existing declarations related to the COVID-19 pandemic or similar emergencies will automatically terminate unless extended by the Legislature on the effective date of this bill.
