This bill mandates that data center owners and operators in New Jersey submit semi-annual water and energy usage reports to the Board of Public Utilities (BPU) for a period of three years. The reports must include basic information about the data center, detailed energy and water usage data, and any additional information deemed necessary by the BPU. For data centers receiving financial incentives from state agencies, the reports must also include performance calculations and sustainability indicators, such as energy reuse factor and water usage effectiveness. Data centers that have been operational for at least one year must submit their first report within three months of the bill's enactment, while others have six months to comply.
The BPU is required to publish the information from these reports on its website within 30 days of receipt, although performance and sustainability data will remain confidential. Data center operators must also notify the BPU of any significant operational changes that would necessitate an update to their reports at least 60 days in advance. After the three-year period, the BPU has the authority to decide whether to make the reporting requirement permanent through the adoption of new rules and regulations.
