This bill establishes a licensure requirement for source plasma donation centers in New Jersey, mandating that no person may operate such a center without a license from the Commissioner of Health. The bill outlines the process for obtaining and renewing this license, which must be done annually, with an initial fee set at $25 for those already operating prior to the bill's enactment. The Commissioner is also tasked with creating rules and regulations to ensure safety and best practices at these centers, including staff training and donor screening procedures. The income generated from the licensing fees will be appropriated to the Department of Health to support the implementation of the act.
Additionally, the bill grants the Commissioner enforcement powers, including the ability to inspect donation centers and suspend or revoke licenses if violations are found. In cases where a violation poses a danger to public health, the Commissioner can suspend a license without prior notice, although the licensee has the right to request a hearing within 48 hours. Penalties for violations range from $100 to $1,000 for the first offense and from $500 to $5,000 for subsequent offenses, with enforcement conducted under the Penalty Enforcement Law of 1999.
