This bill amends New Jersey's cyber-harassment law (N.J.S.A.2C:33-4.1) to expand the definition of cyber-harassment to include online communications made with reckless disregard for the safety of another person. Under the current law, cyber-harassment is defined as making online communications with the purpose to harass another, which includes threats of physical harm, sending lewd or obscene material, or threatening to commit a crime against a person or their property. The bill introduces new language that specifies that cyber-harassment can also occur when a person acts with reckless disregard for another's safety, and it establishes that such reckless behavior constitutes a disorderly persons offense.

Additionally, the bill clarifies the penalties associated with cyber-harassment. If the act is committed purposely or intentionally, it remains a crime of the fourth degree, with increased penalties if the offender impersonates a minor. However, if the act is committed with reckless disregard, it is classified as a disorderly persons offense, which carries lesser penalties. The bill also includes provisions for minors adjudicated delinquent for cyber-harassment, allowing the court to mandate participation in educational programs aimed at reducing such behavior. Overall, the bill aims to strengthen protections against cyber-harassment by addressing reckless online communications.
